Dans le rapport problématique entre médecine et technosciences, les enjeux sont nombreux. Le sujet que je souhaiterai développer dans le cadre du mémoire de Master 2 Ethique de la décision et gestion des risques relatifs au vivant est que l'imagerie cérébrale est un cas d'usage problématique de nos représentations des soins.
La représentation du cerveau par l'imagerie cérébrale soulève un ensemble de questions et génère de nouvelles pratiques tant au niveau juridique qu'au niveau éthique et médical. Son utilisation et son instrumentalisation expriment une responsabilité collective que nous avons le devoir d'assumer. Elle engage notre rapport à la nature et au monde, exacerbant le principe rousseauiste de perfectibilité et poussant inexorablement au culte de la performance tant promue par nos sociétés démocratiques et consuméristes. L'opinion communément admise dans le milieu de la neuro-imagerie est que l'étude du cerveau à travers l'imagerie cérébrale nous dévoilera ce qu'est la conscience humaine, rendant possible l'idée d'une sélection eugénique et génétique de l'idéal de ce que serait une conscience propre à l'exercice de la démocratie, par l'élimination ou du moins la prise en charge et le soin des esprits malades, pathologiques et déviants. Ce mouvement suit une des célèbres maximes de SPINOZA Baruch présente dans "L'éthique" : "Les hommes jugent les choses selon la disposition de leur cerveau". Mais notre rationalité possède des limites.
Le cerveau, c'est 100 milliards de neurones, 10 000 contacts synaptiques. Selon Gérard HEDELMAN, ancien directeur de l'Institut de neuroscience à la Jolla Californie, le nombre de connexions cérébrales possibles est, "plus élevé que le nombre de particules chargées positivement dans l'univers", et il n'y a pas de limite absolue à la combinatoire neuronale.
L'imagerie cérébrale constitue un défi scientifique international majeur de ce début du siècle. En Europe et aux Etats-Unis, elle correspond au plus gros budget de recherche car les enjeux pour l'avenir de l'humanité sont nombreux, aussi bien au niveau individuel que collectif, politique, économique et social. Le malade devient le support d'un développement technologique centré autour de l'idée de progrès.
Au Etats-Unis, l'objectif affiché de "initiativ brain" est d'obtenir une image dynamique du cerveau en action et de comprendre comment on pense, on apprend et on se souvient. En Europe, le "human brain project" est un projet scientifique qui vise d'ici environ 2024 à simuler le fonctionnement du cerveau grâce à un super ordinateur, dont le but affiché est de développer de nouvelles thérapies médicales plus efficaces sur les maladies neurologiques, un des objectifs est de modéliser entièrement le cerveau afin de pouvoir le télécharger dans un monde virtuel. Nous ne sommes pas si loin de "Matrix" finalement. Les applications possibles sont très nombreuses, à l'image d'un des derniers messages du porte-parole du géant Google, sur la volonté de l'entreprise de créer un "troisième hémisphère dans le cerveau" par l'intermédiaire d'une puce implantée connectant l'homme ainsi intra-biologiquement avec internet, recherche que nous pouvons corréler à celle du centre de recherche militaire américain le DARPA.
Au-delà de l'effet d'annonce, la notion de vie bonne aujourd'hui sera peut-être considérée demain comme une vie en deçà de ses potentialités donc pathologique, et il pourra par exemple être proposé un traitement d'implantation invasif d'une interface cerveau-machine, afin d'être plus compétitif sur le marché du travail par exemple, mais aussi un remaniement du génome et la prise de médicaments aux caractères performatifs. Le cerveau et la manipulation de la personnalité sont des champs de la réflexion éthique en médecine et biologie, adoptés par exemple par G.HOTTOIS et M.H. PARIZEAU dans "Les mots de la bioéthique". C'est un problème éthique contemporain posé par la médecine et la biologie apparaissant dans les avis rendus en France par le Comité Consultatif National d'Ethique. Tous ces sujets de recherche partent de l'hypothèse principale que la cognition arrive du cerveau. Nous assistons à une certaine forme de naturalisation de la philosophie, c'est à dire vouloir trouver la conscience biologiquement dans le cerveau (in vivo), et plus seulement à travers le langage.
Le thème central est l'imagerie cérébrale, son impact problématique dans nos représentations des soins, les nouvelles questions éthiques qu'elle soulève, notamment dans son utilisation comme référence en droit et dans l'exercice de la justice.
La thèse est que l'arrivée de l'imagerie cérébrale bouleverse notre conception du soin, impose une nouvelle éthique en rapport avec les générations futures, et modifie intrinsèquement le droit et l'exercice de la justice.
Ainsi dans une première partie, nous tenterons de répondre à la question qu'est ce que l'imagerie médicale, en passant par sa définition, ses limites, le cas de la plasticité neuronale, et le traitement de pathologies cérébrales. Dans une deuxième partie nous développerons l'influence de l'imagerie cérébrale sur le droit, par le phénomène de naturalisation du droit (ou neurodroit), suivie d'une enquête sur les relations entre droit et sciences, pour finir sur la description d'une certaine vision utilitariste et des relations entre éthique et droit. Enfin dans une troisième partie sera abordée la nécessité d'une nouvelle éthique, à travers l'exploration de l'éthique normative, de la neuroéthique, de l'éthique comportementale, ainsi que la relation neuro-imagerie et bouddhisme. Le sujet est à la fois très complexe et très vaste.

In the problematic relationship between medicine and techno, the challenges are many. The subject I will wish to develop in the master memory of the frame 2 Ethics of decision and risk management related to living is that brain imaging is a case of problematic use of our representations of care.
The representation of the brain through brain imaging raises a set of questions and generates new practices both legally and medical ethics that level. Its use and exploitation express a collective responsibility that we have a duty to fulfill. It involves our relationship to nature and the world, Rousseau exacerbating the principle of perfectibility and inexorably pushing the cult of performance as promoted by our democratic and consumerist societies. The conventional wisdom in the middle of neuroimaging is the study of the brain through brain imaging will reveal what human consciousness, making possible the idea of eugenics and genetic selection of Ideally this would be a clean conscience in the exercise of democracy, the elimination or at least the management and care of sick minds, and pathological deviants. This move follows a famous maxims Baruch Spinoza presents in "Ethics": "Men judge things according to the disposition of their brains." But our rationality has limits.

Brain imaging is a major international scientific challenge of the early century. In Europe and the US, it is the largest research budget because the stakes for the future of humanity are many, both individual and collective, political, economic and social. The patient becomes the support of technological development centered around the idea of progress.
In the United States, the stated objective of "initiativ brain" is to get a dynamic picture brain in action and understand how we think, one learns and remembers. In Europe, the "Human Brain Project" is a scientific project designed in about 2024 to simulate the brain with a supercomputer, the stated aim of which is to develop new and more effective medical therapies for neurological diseases one objective is to fully model the brain in order to download it in a virtual world. It is a contemporary ethical problem of medicine and biology appearing in the opinions in France by the National Consultative Ethics Committee. All these subjects depart from the main hypothesis that cognition comes from the brain. We are witnessing some form of naturalization of philosophy, ie wanting to find biologically consciousness in the brain (in vivo), and not only through language.
The central theme is brain imaging, its problematic impact in our representations of care, new ethical questions it raises, particularly in its use as a reference in law and in the exercise of justice.
The thesis is that the advent of brain imaging upsets our conception of care, imposed a new ethics in relation to future generations, and intrinsically alters the law and the exercise of justice.
So in the first part, we will try to answer the question what is medical imaging, through its definition, its limits, the case of neuronal plasticity, and treatment of brain diseases. In the second part we will develop the influence of brain imaging on the right, through the naturalization phenomenon of law (or neurodroit), followed by a survey of the relations between law and science, to finish on the description of some utilitarian vision of the relationship between ethics and law. Finally in the third part will be discussed the need for a new ethic, through the exploration of normative ethics, neuroethics of behavioral ethics and neuroimaging relationship and Buddhism. The subject is both very complex and very broad.
